Terms & Conditions

The rules for using Elephany's website, creator tools and reader experiences.

Agreement and scope

These Terms & Conditions (“Terms”) form a binding agreement between you and Elephany AI (“Elephany”, “we”, “us” or “our”). They apply when you access or use our website, dashboard, embedded question-and-answer experiences, creator tools, waitlist and any related services we make available (collectively, the “Services”).

By using the Services, you confirm that you have read and accepted these Terms. If you use the Services for a company or another organisation, you confirm that you have authority to bind that organisation, and “you” includes that organisation.

What Elephany provides

Elephany helps publishers and recipe creators answer reader questions using the creator’s own content. Depending on the product or plan, the Services may also provide audience insights, engagement tools and monetisation features.

Features may change as the product develops. Any beta, preview or early-access feature is provided for evaluation, may be incomplete and may be changed or withdrawn at any time.

Eligibility and accounts

You must be at least 18 years old and legally able to enter into a contract to use a business account or submit an application for the Services. You must provide accurate information and keep account and contact details current.

You are responsible for activity under your account, for keeping login credentials confidential and for promptly notifying us if you suspect unauthorised access. We may ask you to verify your identity or authority to act for a website or organisation.

Acceptable use

You must not use the Services to:

  • break the law, infringe rights, deceive, harass or cause harm;
  • upload malicious code or interfere with the security or operation of the Services;
  • scrape, reverse engineer or bypass access, usage or safety controls except where law expressly permits;
  • impersonate another person, misrepresent ownership of content or submit content without the necessary rights;
  • send spam, build unlawful profiles or use outputs for unlawful discrimination; or
  • use the Services in high-risk contexts where an incorrect answer could cause death, personal injury or significant property damage.

We may investigate suspected misuse and restrict or suspend access where reasonably necessary to protect users, creators, Elephany or third parties.

Your content and permissions

You retain ownership of content, recipes, website materials, data and other information you provide or connect to the Services (“Your Content”). You confirm that you have all rights and permissions needed for us to process Your Content as described here.

You grant Elephany a non-exclusive, worldwide, royalty-free licence to host, copy, process, format, analyse and display Your Content only as reasonably necessary to provide, secure, maintain and improve the Services, generate answers for your audience and meet our legal obligations. This licence ends when Your Content is deleted from our systems, subject to reasonable backup, legal and security retention.

You are responsible for reviewing the content and settings you make available to readers and for maintaining an appropriate privacy notice on your own website when you use an Elephany embed.

AI-generated answers

Elephany uses automated systems to generate answers from available creator content. AI-generated output can be incomplete, inaccurate or unsuitable for a particular reader. Similar questions may produce different answers.

Outputs are informational and are not medical, nutritional, allergy, legal, financial or other professional advice. Creators remain responsible for their published recipes and editorial decisions, and readers should use appropriate judgement—particularly for allergens, food safety, dietary restrictions and health-related questions.

Waitlist and communications

When you join the waitlist, you ask us to review the recipe URL you submit and contact you about access, onboarding and relevant product updates. Joining the waitlist does not guarantee access, a launch date, pricing or any particular feature.

You may opt out of non-essential marketing messages using the unsubscribe method in the message. We may still send service, security, transactional or legal notices where appropriate.

Third-party services

The Services may depend on or link to third-party hosting, analytics, communications, data-storage, advertising, monetisation and other services. Third-party services are governed by their own terms and policies. We are not responsible for a third-party service that we do not control, although we remain responsible for our own obligations when we appoint a provider to process data for us.

Elephany intellectual property

The Services, including our software, design, branding, documentation and underlying technology, are owned by Elephany or our licensors and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable and revocable right to use the Services for their intended purpose.

If you send feedback, you permit us to use it without restriction or payment, but we will not identify you publicly as the source without permission.

Fees and paid services

If you purchase a paid plan, the applicable order, checkout or plan description will state the fees, billing period, taxes, renewal and cancellation terms. Unless stated otherwise, fees are non-refundable except where required by law. We will provide reasonable notice of material pricing changes before they apply to a renewal.

Availability and changes

We work to keep the Services reliable, but do not promise uninterrupted or error-free access. We may maintain, update, secure, limit or discontinue any part of the Services. Where practicable, we will give reasonable notice of a material change that significantly reduces paid functionality.

Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement and any warranty arising from course of dealing or usage. We do not warrant specific audience, revenue, advertising, search or business outcomes.

Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, goodwill, data or business opportunity, arising from the Services.

Elephany’s total liability arising out of or relating to the Services will not exceed the greater of the amount you paid Elephany for the Services in the 12 months before the event giving rise to the claim or USD 100. These limits do not apply to liability that cannot be limited by law, including fraud, wilful misconduct or death or personal injury caused by negligence where applicable.

Indemnity for business users

If you use the Services for a business, you will defend and indemnify Elephany and its personnel against third-party claims, damages and reasonable costs arising from Your Content, your unlawful use of the Services or your material breach of these Terms. This does not apply to the extent a claim was caused by Elephany’s breach or misconduct.

Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms, create security or legal risk, fail to pay amounts due, or if we discontinue the Services. Where appropriate, we will give notice and a reasonable opportunity to cure.

Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, indemnity and dispute terms—will survive.

Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. The courts located in Hyderabad, Telangana will have exclusive jurisdiction, except where mandatory consumer law gives you the right to bring a claim elsewhere.

Before filing a formal claim, each party agrees to try in good faith to resolve the dispute by written notice and discussion for at least 30 days.

Changes and contact

We may update these Terms to reflect changes to the Services, law or our practices. We will post the revised Terms and update the date above. If a change materially affects your rights, we will provide additional notice where reasonably practicable.
